Reasons

1. Basic facts

가. 피고(변경 전 상호: 상촌건설 주식회사)는 2006. 3. 20. 주식회사 노블팰리스(이하 ‘노블팰리스’라 한다)와 사이에 아산시 I 지상에 J 건물(현재 별지 목록 기재 ‘L빌딩’에 해당한다, 이하 ‘이 사건 건물’이라 한다)을 공사대금 103억 2,800만 원, 준공예정일 2007. 1. 20.로 정하여 신축하는 내용의 공사도급계약을 체결하였다.
