A. The Plaintiff was awarded a contract with the non-party company D (hereinafter "non-party company") for a new building cost of KRW 13,830,00,000 for the construction cost of the non-party company's land E, Daegu-gu, and completed the new building pursuant to the construction contract, but the Plaintiff paid KRW 9,950,000,000 out of the construction cost and paid KRW 3,880,000 for the remainder of the construction cost and interest KRW 1,159,000 for interest and KRW 5,039,000 for interest and KRW 5,039,000 for interest and KRW 5,039,000 for 4,120,380,821 from the non-party company's company on October 28, 209, a notary public completed a debt reimbursement contract with the non-party company No. 664, 200,000 for the non-party company's general legal office, and set the list of real property owned by the non-party company.

B. Defendant A entered into an employment contract with G, the actual manager of the said F building company and the owner of the said new building site of 1,014.8 square meters, and worked as the F building manager from October 10, 201 to June 13, 2012. Defendant A was not paid a total of 30,816,760 won until he/she retires, including KRW 2,696,70, Oct. 10, 201.

C. Meanwhile, as for the instant real estate upon the request of H, which is the first priority collective security right holder, the Daegu District Court Branch C, and the real estate auction procedure (hereinafter “instant auction procedure”). Defendant A filed an application for distribution on the ground that he was not paid KRW 30,816,760 from G, on the ground that he did not receive the wages of KRW 11,100,00 from G, Defendant B received the wages of KRW 11,449,02 as the highest wage creditor, and Defendant B received KRW 5,50,00 as the highest wage creditor on the date of distribution of the instant auction procedure on January 15, 2014, and H, who is the applicant creditor, was paid KRW 28,07,741 as the mortgagee.
