The prosecution of this case is dismissed.
1. Around April 18, 2017, the Defendant: (a) connected the Internet-sharing website (www.todisk.co.co. kr) to one’s ID (C); and (b) infringed the copyright of the copyright holder by 2015, “a video work in which the copyright is owned by “a limited company”, “a video work in which the copyright is owned,” on the bulletin board, and distributed the copyright of the said website to the members of the said site.
2. Determination
(a) Applicable law: Article 136(1)1 of the Copyright Act;
(b) Offenses subject to prosecution upon complaint: Article 140 of the Copyright Act;
(c) Submission of a complaint by an appellant after prosecution;
(d) Judgment dismissing public prosecution: Article 327 subparagraph 5 of the Criminal Procedure Act;
