A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.
Punishment of the crime
"2018 Gohap320"
1. Act on Special Cases concerning the Punishment, etc. of Sexual Crimes and intrusion on a structure;
A. At around 18:00 on January 16, 2018, the Defendant invaded the above apartment in violation of the victim’s will to manage the apartment building, which is a structure, by obtaining a password from the street to D (14 years old), and immediately after D enters the above Cdong, entering the said Cdong pursuant to the joint entrance, and boarding the elevator with D, through the joint entrance, which is still opened.
B. On January 16, 2018, at around 18:38, 2018, the Defendant: (a) followed the victim G (nore and 13 years old); (b) followed the victim G from the Fdong in the Suwon-si Apartmentdong, and (c) went back to the above Fdong; (d) the victim got a joint entrance password; and (e) entered the said Fdong; and (e) the joint entrance was closed. However, the victim misunderstanding the Defendant as an apartment resident again opened the joint entrance, the Defendant entered the said Fdong building into the said fdong building; and (e) the said Fdong first floor of the said Fdong, waiting for the elevator along with the victim, rhym the victim’s head’s hand, and said, “ off the victim’s head.”
Accordingly, the Defendant intruded on the building managed by the Buddhist winners against the will of the Buddhist winners, and forced the victims to commit an indecent act.
C. On January 30, 2018, the Defendant: (a) infringed upon the said apartment in violation of the victim’s non-brupted will who managed the said apartment, by driving away from the previous bus to the age of 15 in the same way as the Defendant, in the manner as the above paragraph (a) of the foregoing paragraph, at H apartment Hadong, which was located in the same bus as the Defendant; (b) around 18:30 on January 30, 2018.
2. Around March 2, 2018, the Defendant, who intrudes into a structure and damages property, was hidingly hiding from the toilet to the waste point, around 21:57 on March 2, 2018.
