1. The Defendant shall pay to the Plaintiff KRW 59,763,00 and the interest rate of KRW 12% per annum from November 14, 2019 to the date of full payment.
1. On September 2017, the Plaintiff filed a claim for the balance of construction works and delay damages based on the same cause as indicated below the claim with the indication of the claim, and the metal construction was conducted among the new construction works, at the request of the Defendant, and the additional construction was conducted at the request of the Defendant twice thereafter.
The original construction cost is KRW 86,00,000, the first additional construction cost is KRW 14,930,000, the second additional construction cost is KRW 23,400,000, and the second additional construction cost is KRW 136,763,00 in total when the value-added tax is added.
The defendant paid only KRW 77,000,000 among them.
Therefore, the defendant is obligated to pay to the plaintiff 59,763,00 won with 12% interest per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the day after the copy of the complaint of this case is served to the day of complete payment.
