1. Any person who intends to occupy and use land in a river area shall obtain permission from the river management agency;

Nevertheless, on August 29, 2017, the Defendant occupied and used 487 square meters of the above land without obtaining permission from the Gangseo-gu Office, a river management agency, in order to raise 30 marinas within the river area located in Gangseo-gu Busan Metropolitan City, Gangseo-gu.

2. Any person who intends to install a structure in a zone subject to development restriction in violation of the Act on Special Measures for the Designation and Management of Areas subject to development restriction shall obtain permission from the competent authorities;

Nevertheless, in 2014, the Defendant installed a structure and a shed to raise 30 marinas without obtaining permission from the Gangseo-gu Office, the competent administrative agency, in a development restriction zone located in Gangseo-gu Busan Metropolitan City, Busan Metropolitan City.
