The instant lawsuit is dismissed.
Litigation costs shall be borne by the plaintiff.
On June 29, 2017, pursuant to Articles 117(2) and 120(1) of the Civil Procedure Act, the court ordered the Plaintiff to provide a security for the costs of lawsuit. On July 7, 2017, the Plaintiff submitted an immediate appeal against the above order to provide a security to the court, but did not attach a stamp.
Therefore, this court issued an order of correction to order the payment of stamp within July 7, 2017, but this court failed to comply therewith, and this court issued an order of rejection of a complaint on July 31, 2017, which became final and conclusive on the same day as the above order of provision of collateral was issued. However, since the plaintiff did not provide a security within the period specified in the above order from the date when the above order of provision of collateral became final and conclusive, it decided to dismiss the lawsuit of this case without pleading pursuant to the main sentence of Article 124 of the Civil Procedure Act.
