) The KMMM is an industrial trade union on a national scale that consists of workers engaged in the metal industry, and the JMMMK branch (hereinafter referred to as the “KM branch”).

) The Defendant’s employees are the branches of Jaman-Jol racing branch consisting of the Defendant’s employees, and L Workers’ Union (hereinafter “L Workers’ Union”).

2) The Defendant is a company that operates the design, manufacture, and sales business of automobile industrial parts. The Plaintiffs are members of the K branch as employees working for the Defendant Company. B. K branch industrial action and the Defendant’s lock-out 1) The Defendant, on February 4, 2010, placed five persons, among 13 factory guard workers, wishing to change production from among 13 factory guards, as production workers, to take exclusive charge of the second factory guard work, and put the first factory guard work to the service company.

2) On February 4, 2010, K Branch refused to engage in overtime work and night work by asserting that “the outsourcing of security services is in violation of a collective agreement, and must be withdrawn.” On February 5, 2010, K Branch decided to conduct industrial action by vote at the general meeting of the union members with the consent of 92%, and refused to engage in overtime work for 8 hours in the normal working hours and 2 hours in the same day. From February 9, 2010 to February 12, 2010, K Branch engaged in 70% reduction of the production volume for 10 hours in the industrial action. 3) The Defendant, against the industrial action, carried out a lock-out part of the contents that prohibit the Defendant’s member’s entry into and departure from the Defendant’s passenger factory and the entire commercial factory.

C. When the lock-out 1 of the first general assembly was long-term, the members of the K branch conference are “M organization” on April 20, 2010.
