Reasons

1. The Plaintiff and the Defendants are co-owners of land 17455m2 (hereinafter “the instant forest”). The Plaintiff sought a partition of the jointly owned property against the Defendants, which is the co-owners of land 1745m2 (hereinafter “the instant forest”).

2. Grounds for recognition;

(a) Defendant B: Judgment by publication service (Article 208(3)3 of the Civil Procedure Act);

(b) Defendant C: Judgment deemed to be a confession (Articles 208(3)2 and 150(3) of the Civil Procedure Act)
