The defendant's appeal is dismissed.
Reasons
The gist of the Defendant’s appeal is that, although the Defendant did not have committed E at the time of the instant case, the lower court erred by misapprehending the facts and thereby affecting the conclusion of the judgment.
However, according to the consistent and consistent statements of E as to the circumstances in which damage was inflicted at the time of the instant case and the statements of F and J in support thereof, the above assertion is without merit, since the facts constituting the instant crime against the Defendant can be acknowledged.
Accordingly, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act.
