The prosecution of this case is dismissed.
Reasons
1. On December 2, 2019, the Defendant assaulted the victim’s face face by making it known to the victim D(the age of 62) and drinking with his/her main business owner at Anyang-si B and 1st underground level, around 01:30 on December 2, 2019.
2. The facts charged of this case cannot be prosecuted against the victim's express intent under Article 260 (3) of the Criminal Act as a crime falling under Article 260 (1) of the Criminal Act. According to the agreement submitted to this court, the victim has withdrawn his/her wish to punish the defendant after the prosecution of this case. Thus, the prosecution of this case is dismissed in accordance with Article 327 (6) of the Criminal Procedure Act.
