【Criminal Facts】

No person may provide telecommunications services provided by a telecommunications business operator for any third person's communications.

On August 16, 2018, the Defendant accepted the phrase “the Plaintiff, through a telephone, may allow a business operator to borrow KRW 60 million at the small and medium enterprise office as 5% per annum,” and then, accepted the phrase “the Defendant’s business operator registration under the name of the party and a change via an Internet phone.”

Therefore, on August 30, 2018, the Defendant applied for the registration of the advertising agency business operator with the trade name "D" from the Nowon Tax Office located in 69-ro 14, Dobong-gu Seoul, Seoul, on August 30, 2018. On September 4, 2018, the Defendant sent the above business registration information, such as the business registration number, to the above C through the mobile phone E, and decided to install an Internet telephone in the name of "D" by phone call to the F enterprise Telephone subscription center, and notified C of the phone number of the said operator of the above subscription center, thereby allowing C to purchase and use the F phone in the name of the Defendant.

On September 5, 2018, the Defendant: (a) allowed the said C to open seven telephone numbers (G, H, I, J, K, K, L, M, and N) provided by F in the name of “D”; (b) allowed the C to open one telephone number (G), provided by F in the same name on September 10, 2018; and (c) used the said eight telephone numbers to the said C or nameless singing staff.

Accordingly, the defendant provided 8 lines telecommunications services provided by telecommunications business operators for the purpose of telecommunications.
