Examining the evidence duly admitted by the court below, the court below is justified to reverse the judgment of the court of first instance which acquitted the victim D, on the grounds as stated in its reasoning, and convicted the victim D of fraud.

There is no error of exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or of misunderstanding the legal principles on the criminal intent of defraudation in fraud.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
