A. On January 16, 2014, the Plaintiff and the Defendant concluded a construction contract and completed construction works. On January 16, 2014, the Plaintiff and the Defendant concluded a construction contract with the Defendant, among the new construction works of complex building C on the ground D (hereinafter “instant E construction works”).

(2) The contract form in which the contract amount shall be determined in 230,000,000 won (excluding value-added tax) and shall be awarded (hereinafter referred to as “instant E contract form”).

2) On September 4, 2014, the Plaintiff and the Defendant drafted a contract agreement with the Defendant that the Plaintiff would additionally receive a contract for the instant H work with the amount of KRW 154,00,000 for the work cost, among the construction works for construction works for F and G ground lending (hereinafter “instant H work”). On January 9, 2015, the Plaintiff and the Defendant drafted a contract agreement with the Defendant to additionally receive a contract amount of KRW 24,00,000 for the construction cost of the instant H work, respectively.

3) The instant E Corporation and H Corporation (the combination of the aforementioned two works) shall be referred to as “each of the instant works.”

(4) The Plaintiff issued a total of KRW 247,940,000 (including value-added tax) to the Defendant during the period from May 30, 2014 to December 31, 2014 with respect to the instant E project.

5) On January 23, 2015, the Plaintiff issued a tax invoice of KRW 178,00,000 to the Defendant with respect to the instant H construction work. (b) The Defendant paid KRW 20,000,000 to the Plaintiff as the construction price of the instant construction work, and KRW 20,000,000 on August 12, 2014, and KRW 50,000,00 on September 5, 2014. The Defendant paid KRW 28,00,000 to the Plaintiff as the construction price of the instant H construction work.

2 The Defendant paid to the Plaintiff KRW 10,000,000 on December 13, 2015, and KRW 22,000,00 on December 30, 2015, after filing the instant lawsuit.

C. The Plaintiff and the Defendant agreed to settle the construction cost between the Plaintiff and the Defendant on January 13, 2016, with respect to the payment of the construction cost of each of the instant construction works, the Defendant up to January 31, 2016, as well as the remaining construction cost of KRW 275,940,000.
