The prosecution of this case is dismissed.
1. 공소사실의 요지 피고인은 2012. 4. 2. 10:09경 불상의 장소에서 다음(Daum) 미디어의 인터넷 기사 “女교수와 바람 피우다 걸린 50대 중령, 전역하려다 ”라는 글에 댓글로 “개인적인 일이 그 일 아냐 이 시키도 쥐바귀 같은 넘이네 ㅎㅎㅎㅎㅎ 차라리 떡검이나 천화대 쥐새끼들 사표는 바로 받아주면서 왜 차별하냐 이러는게 맞는거 아냐 ”라는 글을 게시하였다.
Accordingly, the defendant insultd the victim C(51 years of age) who is "the 50 major age of the Internet article."
2. The facts charged of this case are crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when the victim files a complaint under Article 312(1) of the Criminal Act. According to the records of this case, it can be acknowledged that the victim expressed his/her intention not to punish the defendant after the prosecution of this case was instituted. Thus, the prosecution of this case is dismissed in accordance with Article 327(5) of the Criminal Procedure Act.
