1. The Defendant shall pay to the Plaintiff KRW 100,000,000 as well as 20% per annum from April 4, 2015 to the day of complete payment.
According to the overall purport of Gap evidence Nos. 1 through 6 and arguments, Eul approved that the basic terms and conditions of credit transactions of SB Savings Bank (former Switzerland2 Mutual Savings Bank) on April 18, 2008 apply to B, and offered as security C Apartment 101 Dong 1006, Yangcheon-gu, Seoul, which is owned by the defendant, and received 483,000,000 won from SB Savings Bank after concluding a credit transaction agreement with SB Savings Bank. Interest rate is 12% per annum, overdue interest rate is 24% per annum, repayment date is 24% on April 18, 2010. The defendant jointly and severally guaranteed the above debt obligation of B, which is part of the auction order of real estate, are satisfied, and the debt amount of B is currently 208,263,538,000 won, and the defendant can be recognized that the plaintiff is liable to pay the plaintiff 205,000 won, 205,000 won,000 won,00 won.
In this regard, the defendant asserts that the EP Savings Bank had already transferred the claim of this case to the National Uniform Fund of Korea, and thus it cannot accept the plaintiff's claim of transfer money. However, according to the fact-finding findings of this court's fact-finding on EP Savings Bank, it is recognized that the claim of this case transferred to the National Uniform Fund of Korea and the claim of this case are separate claims. Therefore, the plaintiff's claim is reasonable, and it is decided as per Disposition by admitting it.
