In full view of the various circumstances, such as the fact that the Defendant’s judgment is against the instant crime, etc., and the victim’s bereaved family members in the crime of violating the Act on Special Cases concerning the Settlement of Traffic Accidents due to the purchase of a motor vehicle comprehensive insurance policy are paid in total in KRW 75,209,90, and the victim’s bereaved family members’ property damage is recovered, etc., the lower court’s punishment is too unjustifiable and unreasonable.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
