The defendant is a person who is engaged in driving a C-Ma cargo vehicle.

당시는 야간이고, 그 곳은 우측으로 굽은 내리막길 고속도로로서, 약 90미터 전방 갓길에서 피해자 D( 남, 46세), 피해자 E( 남, 42세) 이 F 25톤 덤프트럭의 운전석 쪽 뒷바퀴 교체작업을 하고 있었으며, 사고를 막기 위하여 위 덤프트럭 후방 약 300 미터 구간에 LED 라 바 콘이 설치되어 있었고, 위 E의 동료인 G이 위 덤프트럭 후방에 비상등을 켠 트럭을 세워 둔 상태로 안전봉을 들고 수신호를 보내고 있었으므로, 이러한 경우 운전업무에 종사하는 사람에게는 속도를 줄이고 전방 및 좌우를 잘 살피면서 진행하고, 조향 및 제동장치를 정확히 조작하여 사고를 막아야 할 업무상의 주의의무가 있었다.
