가. 피해자 D 피고인은 2012. 7. 22. 15:00경 피고인의 주거지인 위 C빌라 앞 골목길에서, 제1항과 같이 소란을 피운 것을 이유로 경찰 조사를 받고 나온 것에 화가 나, 위 E건물 302호에 있던 피해자 D를 향하여 큰소리로 “니가 나를 고소를 해, 씨발놈아, 너 이리 나와 봐, 나와 보라니까, 다 죽여버릴 거야, 니가 백날 나를 고소해봐라, 그래봐야 벌금 200만원이면 끝이다. 내가 너를 가만두지 않을 거야”라고 말하고, 계속하여 같은 날 16:00경 같은 장소에서, 피해자의 신고를 받고 출동한 경찰관 F 등이 있는 가운데 피해자를 향하여 다시 큰소리로 “저 똘아이 새끼가 나를 고소했어, 너 내가 가만히 두지 않는다”라고 말을 하였다.

나. 피해자 G 피고인은 2011. 10월 중순 22:00경 피고인의 주거지인 위 C빌라 302호에서, 성명불상자 2명이 있는 가운데 그 곳 골목길에 있던 피해자 G에게 “니가 뭔데 나한테 지랄이냐, 십쌔끼, 좆같은 새끼야”라고 욕설을 하였다.
