The judgment below

Examining the reasoning of the judgment below in light of the relevant legal principles and the records, it is just to determine that the Defendants’ benefits received by the Defendants are merely the consumption of criminal proceeds, and thus, it cannot be collected separately from the Defendants, and contrary to what is alleged in the grounds of appeal, there were no errors by misapprehending the legal principles on additional collection.

On the other hand, the prosecutor appealed the entire judgment of the court below, but the guilty part does not indicate the grounds of appeal in the petition of appeal or the reasoning of appeal.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
