The prosecution of this case is dismissed.
Reasons
1. On February 14, 2018, the Defendant assaulted the Victim C (46 years of age) in front of the exit No. 21, KTX 2, a luminous field, 21, in light of light lighting field around 17:0, the Defendant: (a) obstructed the shoulder of the Victim C (46 years of age); and (b) dump the clothes.
2. Determination is an offense falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the same Act. Since the victim withdraws his/her wish to punish the Defendant on April 24, 2018, which was after the instant indictment, the prosecution of this case is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
