Defendant shall be punished by imprisonment for a term of one year and six months.
Criminal facts
1. On June 13, 201, the Defendant against the victim C made a false statement to the victim C, who was aware of the fact before the E parking lot located in Jung-gu Seoul Metropolitan Government D, stating that “I would give two to three times the amount invested every year if it is invested in the parking lot business.”
However, even if the defendant receives investment from the victim, he/she was thought to consume all of his/her personal debt and living expenses, so he/she did not have the intent or ability to pay the victim the parking lot business investment profit.
As such, the Defendant, by deceiving the victim as such, received KRW 23 million from the victim to the bank passbook (Account Number F) in the name of the Defendant in the name of the victim, and acquired it by means of the above four times from the above date to August 22, 201, including the transfer of KRW 80,000 from the victim to the bank account book (Account Number F) in the name of the Defendant.
2. Around August 2011, the criminal defendant against the victim G made a false statement to the victim “I” in the victim G operation in Seocho-gu Seoul Metropolitan Government H, stating, “I will give a monthly profit of KRW 3 million to the victim who was aware of the fact that he/she invested in the parking lot business in J.”
However, even if the defendant receives investment from the victim, he/she was thought to consume all of his/her personal debt and living expenses, so he/she did not have the intent or ability to pay the victim the parking lot business investment profit.
As such, the Defendant, by deceiving the victim, received KRW 5 million from the victim to the passbook (Account Number F) in the name of the Defendant on October 17, 2011, under the name of the victim, and obtained money from the victim by means of the above three times from the above date to October 25, 201, as shown in the attached Table of Crimes List (2), and acquired it by deceiving the victim by means of the above three times from the above date to October 25, 201.
