1. The Defendant was commissioned as an insurance solicitor belonging to the victim D Co., Ltd. operating an insurance agency in the Seo-gu, Seo-gu, Gwangju on November 7, 2014, and was engaged in soliciting insurance until March 2015.

For the purpose of receiving performance fees from the company without the intention to enter into an insurance contract, the Defendant had a customer who has no intent or economic ability to maintain the insurance contract by paying the insurance premium on behalf of the customer, and had the policyholder enter into the insurance contract and reported the insurance company's performance to obtain the performance fees.

Accordingly, on November 11, 2014, the Defendant entered into an interesting country life insurance contract (free) with E and insurance premium on condition that he/she will substitute for E and insurance premium, and received an application for purchase of insurance from the victim company and received 6,495,237 performance fees from the victim company on December 26, 2014, and received 6,495,237 performance fees from the victim company to the national bank account in the name of the Defendant on December 26, 2014 and received 18 applications for purchase of insurance from the victim company until March 31, 2015, and received 18 applications for purchase of insurance from the victim company and received 41,582,518 won in total as performance fees until March 26, 2015 (attached Form 11-11-11-31-31, 203331-31, 2015).
