The judgment below

Examining the reasoning in light of the evidence duly admitted by the court below, the court below’s determination that the facts charged in the instant case is guilty on the grounds as stated in its reasoning is justifiable in accordance with the purport of the judgment of remanding. There is no error of law by misapprehending the legal principles on “in relation to election campaign” under Article 256(3)1 of the Public Official Election Act, “in order to have an influence on election” under Article 90(1) of the Public Official Election Act, “other advertisements”, “other advertisements”, and “publication” and “justifiable acts,” as alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
