1. Basic facts

A. In order to create a housing complex in accordance with the replotting method under the Urban Development Act, Defendant Pyeongtaek-si Urban Development Project Association (hereinafter “Defendant Association”) is an association established for the purpose of an urban development project with the purpose of 436,898m2 (hereinafter “instant urban development project”), which is the implementor of the instant urban development project, and the Defendant Energy Bank Co., Ltd. Article 3 (Provision of Place) of the Urban Development Project of Pyeongtaek-si and 3 (Provision of Place) provides for convenience by preparing a substitute space at the present level of buildings so that the Plaintiff Foundation can view the works until the completion of the urban development project. Article 5 (Matters of Special Agreement) 1) of the Pyeongtaek-si Urban Development Project and the Defendant Company may make maximum efforts to provide the Plaintiff Foundation with the land substitution ratio, reflecting the Plaintiff Foundation’s request to the maximum extent possible.
