1. The Defendant’s KRW 154,252,560 as well as 15% per annum from February 23, 2018 to May 31, 2019 to the Plaintiff.
In light of the facts without dispute, the evidence Nos. 1 and 2 and the purport of the entire pleadings, the Plaintiff is a company that produces and sells the aggregate sheet, and the Defendant is a company that manufactures various products using the original sheet with the trade name of “C”, and the Defendant is recognized as having the amount of the unpaid price from the Plaintiff to January 2018, which is KRW 154,252,560 (including value-added tax).
According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 154,252,560 won for the unpaid goods and damages for delay at the rate of 15% per annum from February 23, 2018 to May 31, 2019, under the former Act on Special Cases concerning Expedition, etc. of Legal Proceedings, and 12% per annum from the next day to the date of full payment.
Thus, the plaintiff's claim of this case is accepted on the ground of the reasons.
