[2014 Highest 3343] On April 14, 2014, the Defendant discovered the key of the entrance set up in the wing factory of the victim D (hereinafter “instant factory”) located in Jongno-gu Seoul Metropolitan Government, and used it to use it in the office, and sited above the work unit at which the victim was dismissed. In short, the Defendant failed to commit an attempted crime, at around 00:30, 2014, the Defendant discovered the key of the entrance set up in the wing factory of the victim D in Jongno-gu Seoul Metropolitan Government (hereinafter “instant factory”).

1. At around 16:00 on February 4, 2014, the Defendant: (a) opened the door door opened by the victim F in Jongno-gu Seoul, Jongno-gu, Seoul; (b) opened the door door opened by using the cresh of the victim’s cresh; and (c) stolen the Defendant’s physical cards in commercial banks, such as the new bank, our bank, national bank, Japanese bank, No. 1 bank, Nonghyup Bank, and Enterprise Bank, and one Samsung Card.

On February 4, 2014, the Defendant: (a) around 17:07, 1460 thousand won in cash: (b) included a new bank body card in the name of F, as described in paragraph (1), in the cash payment period at the Chang-dong branch of Jongno-gu Seoul Chang-dong Bank; (c) withdrawn KRW 60,000 in cash on two occasions; (d) included the stolen Samsung Card in the F’s name; and (e) withdrawn KRW 1.4 million in cash on three occasions.

Accordingly, the defendant stolen 1,460,000 won in cash managed by the victim's false names.

3. On February 4, 2014, the Defendant violated the Specialized Credit Financial Business Act: around 17:10 on February 4, 2014, put a stolen Samsung Card in the name of the F, as described in paragraph (1) of the said paragraph, into the cash payment period for the Chang-dong Bank Chang-dong, Jongno-gu, Seoul, and withdrawn 1.4 million won through cash services on three occasions and used a stolen credit card.
