1. The defendant shall pay 39,150,000 won to the plaintiff and 12% per annum from December 20, 2019 to the day of complete payment.
Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 and 2, it can be acknowledged that the plaintiff received and completed the removal works from the defendant around June 2019, and each of the construction cost was 6,820,000,23,100,000,100,100,130,000, and8,130,000.
Therefore, the defendant is obligated to pay to the plaintiff the total construction cost of KRW 39,150,00 and damages for delay calculated at the rate of 12% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from December 20, 2019 to the day of full payment, which is the day following the delivery of a copy of the complaint in this case. Thus, the plaintiff's claim is justified.
