1. The defendant shall pay to the plaintiff KRW 25,059,203 and KRW 12,027,881 among them, per annum from February 8, 2017 to the day of full payment.
1. Around September 15, 2010, the claim display Capital Co., Ltd. (hereinafter “Ariju Capital”) loaned a loan to the Defendant at 26.9% per annum on interest rate of KRW 14.3 million, overdue interest rate of KRW 32.9% per annum, and the loan period of 36 months.
On June 23, 2015, Aju Capital transferred the obligation to the Plaintiff to the Defendant, and notified the Defendant of the assignment of the obligation on January 5, 2017.
As of February 7, 2017, the principal and interest of the above loans are KRW 25,059,203 (the principal and interest of the loans are KRW 12,027,881).
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated by the rate of 32.9% per annum, which is the interest rate for delay from February 8, 2017 to the date of full payment, with respect to KRW 25,059,203 as well as KRW 12,027,81 as principal.
