1. The defendant shall pay 38,500,000 won to the plaintiff and 20% per annum from July 15, 2005 to the day of complete payment.
On June 29, 2005, the Plaintiff applied for a payment order against the Defendant with the Gwangju District Court 2005Guj2859, the Busan District Court YYYYYYYYYYYYYYYYYYY 2005, and applied for a payment order to the Plaintiff on June 29, 2005 (hereinafter “previous payment order”). The above previous payment order was served on the Defendant on July 14, 2005 and confirmed as is July 29, 2005. However, since the Plaintiff delivered the previous payment order, the Plaintiff was unable to receive KRW 38,50,000 from the Defendant until now, and the fact that the Plaintiff applied for a payment order again on April 14, 2015 does not conflict between the parties concerned, or is recognized by the purport of the entire pleadings and evidence No. 1.
Therefore, the defendant is obligated to pay to the plaintiff 38.5 million won with 20% interest per annum from July 15, 2005 to the day of full payment, which is the day following the day when the original copy of the previous payment order was served on the defendant.
The plaintiff's claim is accepted.
