1. The Defendant’s KRW 40,000,000 as well as the Plaintiff’s annual rate from February 8, 2016 to March 13, 2018.
Comprehensively taking account of the overall purport of evidence Nos. 1-1, 2, and 2-1 and 2-1, the Plaintiff may recognize the Defendant each of the loans of KRW 10 million on January 29, 2016, and KRW 30 million on February 7, 2016.
Therefore, the defendant is obligated to pay to the plaintiff 40 million won in total and after the above lending date, 5% per annum as stipulated by the Civil Act from February 8, 2016 to March 13, 2018, the delivery date of a copy of the complaint of this case, and 15% per annum as stipulated by the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings, from the next day to the day of full payment.
The plaintiff's claim shall be accepted on the grounds of its reasoning.
