1. The following facts do not conflict between the parties, or the following facts are acknowledged, based on Gap evidence 1, Gap evidence 2, Gap evidence 3, Gap evidence 5, Gap evidence 7, and Gap evidence 8, and the result of this court's entrustment of the medical record appraisal to the Hanwon University Hospital as of October 28, 2015, and the purport of the whole pleadings, and there is no counter-proof.
Plaintiff
A On August 1, 1998, between the Defendant and the Defendant, the insured Non-Party F (hereinafter referred to as “the deceased”) and the maturity date until August 1, 2018, and entered into a non-distribution spectrum transport accident insurance contract (hereinafter referred to as “instant insurance contract”) with the insurance period of 20 years.
B. According to the instant insurance, the beneficiary is the deceased in the event of injury, and the amount of insurance coverage due to traffic is KRW 10,000,000.
C. The requirement for payment of the daily traffic accident pension under the insurance of this case refers to the condition of disability of Grades I and II in the disability classification table due to the traffic disaster that occurred during the ordinary day of the insurance period, and 3,000,000 won shall be paid every month for 10 years (120 times) from the relevant day when the cause for payment of insurance money occurs.
On April 3, 2013, the Deceased was discharged on April 3, 2013 from Gangwon University Hospital on the same day as the day when he she was faced with a 11:00 Libera and his head was able to move into the G Hospital (hereinafter “the first accident”), and was transferred to the Gangwon University Hospital.
E. On July 24, 2013, the Deceased, who was hospitalized in a H convalescent hospital, escaped from the H convalescent hospital without permission on August 18, 2013, and was used in childbed on August 19, 2013 (hereinafter “the second accident”), and was found to have a critical condition in the head of the hospital due to the occurrence of a serious accident on August 19, 2013 (hereinafter “the second accident”). Accordingly, the Deceased University Hospital was hospitalized in the Gangwon University Hospital on September 3, 2013 after being hospitalized in the said hospital on a tent and the removal of blood transfusion. < Amended by Act No. 11903, Sep. 13, 2013>
