Judgment without holding any pleadings: The Plaintiff claims damages for delay calculated at the rate of 20% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from August 3, 2006 to the date of full payment: Provided, That the Plaintiff claims against the Defendant for damages for delay calculated at the rate of 15% per annum under the main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 26553, Sept. 25, 2015; effective October 1, 2015). However, the Plaintiff’s claims for damages for delay in excess of the above rate of 15% per annum from October 1, 2015 to the date of full payment are dismissed as there is no justifiable ground.
