The prosecutor's appeal is dismissed.
Reasons
1. According to the summary of the grounds for appeal (misunderstanding of the facts), the court below found the Defendant not guilty of the facts charged of this case, even though it can be found the facts charged.
2. Based on its reasoning, the lower court rendered a not-guilty verdict on the facts charged of this case. Examining the lower court’s instructions closely with the records of this case, the lower court’s determination is acceptable, and the Prosecutor’s assertion of misunderstanding the facts alleged in this case is without merit.
3. The appeal by the prosecutor of the conclusion is dismissed on the ground of appeal.
