A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of six months.

However, as to Defendant B, it shall be for two years.

Defendant

A was sentenced to ten months of imprisonment with prison labor for larceny, etc. at the Seoul Central District Court on December 21, 2012. On August 20, 2013, the Seoul Central District Court was sentenced to two times of punishment for larceny, one time of suspended execution, one time of suspended indictment, and two times of juvenile protective disposition.

1. 피고인 A 피고인은 2014. 10. 11. 04:50경 고양시 덕양구 D건물 4층 비상계단에서 피해자 E 소유인 시가 30만 원 상당의 삼천리 스팟 자전거를 미리 소지한 니퍼로 잠금장치를 자르고 끌고 간 것을 비롯하여 그 무렵부터 2015. 7. 24.경까지 별지 범죄일람표 (1)과 같이 총 18회에 걸쳐 피해자들 소유인 시가 합계 736만 원 상당의 자전거를 끌고 가 절취하였다.

2. 피고인 B 피고인은 2014. 10. 12. 10:00경 ~ 11:00경 고양시 덕양구 F에 있는 자신이 운영하는 ‘G’에서 A이 절취한 피해자 E 소유인 시가 30만 원 상당의 삼천리 스팟 자전거를 장물인 정을 알면서도 2만 원에 매입하여 취득하는 등 그 무렵부터 2015. 7. 25.경까지 별지 범죄일람표 (2) 기재와 같이 총 16회에 걸쳐 피해자들 소유인 시가 합계 571만 원 상당의 자전거를 위와 같은 방법으로 취득하였다.
