The Defendant is a captain who is responsible for overall control over the operation and operation of a fishing vessel on board without registration (five tons, a wooden vessel, six persons on board, and vessel owners: C (PP) and C (PP). hereinafter “instant fishing vessel”), and is a foreigner of Chinese nationality.

피고인은 2016. 9. 27. 18:00경 대한민국 영해인 인천 옹진군 백령도 남동방 2.6해리 해상(북위 37도55.43분, 동경 124도46.78분, 영해 15.1해리 침범)에 정박하여 악화된 기상에 대비하고 조업을위한 준비를 하던 중, 대한민국 영해에 외국 어선이 정박해 있으므로 어로 행위 혐의가 있을 것으로 인정한 해경이 10:45경 고속단정으로 접근하자, 10:50경 닻의 양묘를 완료한 뒤 전속력으로 북측으로 도주하고, 10:58경 해경 고속단정이 근접하여 싸이렌을 울리고, 경광등을 켠 채 이 사건 어선을 선회하면서 정지 신호를 하였음에도, 이를 무시하고 계속 북측으로 도주하다가, 11:02경 대한민국 영해인 위 백령도 남동방 3.6해리 해상(북위 37도55.56분, 동경 124도48.68분, 영해 13.7해리 침범)에서 해경에 의하여 나포되었다....
