2. The parties' assertion

A. The Plaintiff’s assertion that: (a) around August 2014, the Defendant signed a material supply contract with A, C, D, and E, an employee of the Defendant’s agent; and (b) supplied the materials at the instant construction site; (c) the Defendant is obligated to pay the Plaintiff the material price of KRW 31,477,391 and the delay damages therefrom.

B. The defendant's assertion did not conclude a material supply contract with the plaintiff, and the plaintiff entered into a material supply contract with the F Co., Ltd. that received a subcontract for the construction of this case from the defendant, and supplied materials at the site of the construction of this case, so the defendant does not bear a material price liability against the plaintiff.
