The prosecution of this case is dismissed.
On June 5, 2019, at around 14:40, the Defendant assaulted the victim with his/her breast part and face part with his/her hand, on the front of the C store located in Kimpo-si B, Kimpo-si, on the ground that the victim D (the age of 68) entered the one-way road and obstructed the passage of the Defendant.
2. Determination
(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
C. On June 25, 2019, prior to the institution of public prosecution of this case, the victim’s intention not to punish the victim is indicated (Evidence No. 26 pages)
(d) Judgment dismissing public prosecution: Article 327 subparagraph 2 of the Criminal Procedure Act;
