1. The Defendants jointly and severally pay to the Plaintiff KRW 21,143,711 and KRW 20,741,91 among them, with full payment from June 12, 2019.
According to the purport of Gap evidence Nos. 1 through 6 and all pleadings, the plaintiff extended a loan of KRW 52 million to defendant C Co., Ltd. on July 14, 2017. The terms and conditions of the loan include "8.9% per annum, 1,291,50 won per annum, and 25% per annum per annum for delay delay delay." The defendant D guaranteed the above loan of the defendant C Co., Ltd.; the defendants delayed payment of principal and interest from December 5, 2018; the principal and interest under the above loan contract are KRW 21,143, 711 (principal principal, 20,741, 910) as of June 11, 2019.
According to the above facts, since the defendants have lost the benefit of time, they are jointly and severally liable to pay to the plaintiff 21,143,711 won (the principal and interest thereof) and 20,741,910 won (the principal and interest thereof) from June 12, 2019 to the date of full payment.
The claim of this case is justified, and it is so decided as per Disposition.
