1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Basic facts
A. On September 24, 2009, the Plaintiff and the Defendant concluded an insurance contract (hereinafter “instant insurance contract”) with the Defendant as the insured and the beneficiary as indicated in the attached Form as the beneficiary.
B. The Defendant paid KRW 21,490,133 as the insurance money under the instant insurance contract, when he/she received hospitalized treatment for a total of 336 days from January 22, 2010 to April 1, 2017, as indicated in the following table (hereinafter “instant hospitalized treatment”). The Defendant received KRW 21,490,133 as the insurance money from the Plaintiff according to the instant insurance contract.
