A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Punishment of the crime

D filed a lawsuit seeking revocation of disposition such as the return of subsidies for employment maintenance (Seoul District Court 2013 Guhap 1799) with the head of the Gwangju District Court of Labor Office as the defendant.
The reason for the loss of the insured status of employment insurance is "personal circumstances" despite the resignation of the defendant at the recommendation of the defendant, and the training center requested the person in charge of the training center to change the reason for the loss of the insured status to "retirement due to corporate circumstances".
Accordingly, on March 7, 2012, the training center officer requested the Gwangju Regional Labor Agency Branch Office of the Gwangju Regional Labor Office to correct the reason for the loss of the insured status of E from "personal circumstances" to "retirement due to the company's circumstances" but failed to be treated as incomplete documents.
Since then, the defendant could not receive subsidies for employment maintenance if he/she revealed the resignation of E during the period of temporary retirement, and the reason for the loss of E's insured status.
