1. The real estate listed in the attached Table 1 shall be put to an auction, and one half of the amount calculated by deducting the auction expenses from the price shall be deducted;
Reasons
The plaintiff and the defendant are owners of 1/2 of each share in the real estate listed in the attached Table 1 list.
The plaintiff, one of the co-owners, filed a claim for the division of the co-owned property because the agreement on the division of the co-owned property has not been reached between the original defendant and the original defendant. Since the above real property cannot be divided in kind as an apartment house, it seems that it is appropriate to sell the auction proceeds to the auction
It is so decided as per Disposition.
