The reasons for the court's explanation concerning this case are as follows: "the defendant" in the second half of the judgment of the first instance is "the plaintiff"; "the witness D's testimony" in the third half of the first instance judgment is "the witness D's testimony and the witness E's testimony" in the first instance judgment is "the witness of the first instance court"; and the new evidence newly submitted in the trial and lack of recognition of the plaintiff's assertion is the same as the reasons for the first instance judgment except for the rejection of the plaintiff's statement in the evidence No. 4 and part of the witness E of the party trial. Thus, it is accepted in accordance with the main sentence of Article 420 of the Civil Procedure Act.
