The defendant is limited to the sale on March 18, 2019 with respect to each of the real estates listed in the attached Form 1/2 to the plaintiff.
1. According to the evidence evidence Nos. 1 through 6 of the judgment as to the cause of the claim, the Plaintiff entered into a contract with the Defendant to purchase 1/2 shares of each of the real estate listed in the separate sheet (hereinafter “instant real estate”) from the Defendant on March 18, 2019 (hereinafter “instant sales contract”), and the down payment of KRW 27.4 million shall be paid on the date of the contract, and the remainder amount of KRW 20 million shall be paid on March 25, 2019; the Defendant issued all documents necessary for the registration of the ownership transfer of each of the instant real estate to the Plaintiff on the remainder payment date, and cooperate in the registration procedure; the Plaintiff agreed to deliver each of the instant real estate to the Defendant on the same day; the purchase price under the instant sales contract; the down payment of KRW 27.4 million on March 20, 2019; and the remainder of KRW 25 million on March 25, 2019.
According to the above facts, the defendant is obligated to implement the registration procedure for transfer of ownership with respect to shares of 1/2 of each of the instant real estate to the plaintiff, except in extenuating circumstances.
2. First of all, the defendant asserts that the defendant cannot respond to the plaintiff's claim, since all documents necessary for the procedure for the registration of ownership transfer of each real estate of this case are delivered to the plaintiff.
However, it is not sufficient to recognize that the Defendant provided all the documents necessary for the registration procedure of ownership transfer of each real estate of this case to the Plaintiff only with the statement of No. 2, and there is no evidence to acknowledge otherwise.
Even if the Defendant delivered documents necessary for the procedure for the registration of ownership transfer of each of the instant real estate to the Plaintiff, the Defendant, as a seller of the instant sales contract, is obligated to cooperate in completing the registration of ownership transfer for 1/2 shares of each of the instant real estate in the name of the Plaintiff.
