1. Determination as to the cause of claim
A. The Plaintiff’s assertion: (a) while the Plaintiff was employed and worked as the Defendant’s community bus driver on August 3, 2014 as the Defendant’s community bus driver, who runs the bus transport business, etc., on September 20, 2015, the Plaintiff was promoted to the Defendant’s community bus driver on September 20, 2015 and was employed as a route dog driver from September 25, 2015; and (b) the Defendant unfairly dismissed the Plaintiff on October 7, 2015 without justifiable grounds; (c) accordingly, the Defendant’s dismissal on October 7, 2015 against the Plaintiff is null and void; and (d) the Defendant is obliged to pay the Plaintiff wages during the period of dismissal.
B. The plaintiff's assertion based on the premise that the plaintiff was the defendant's employee is without merit, since there is no evidence to acknowledge that the plaintiff was the defendant's employee by entering into an employment contract with the plaintiff and the defendant.
