피고인은 2012. 8. 20. 02:21경 김해시 B 식당 앞 노상에서, 피해자인 경찰관 C이 술값 문제로 신고를 받고 현장에 도착하여 신고 경위를 확인하고 있던 중 위 식당 주인의 말만 들어준다는 이유로 “씨바 좃 같네”라고 약 20여 분간 큰소리로 말하여 공연히 그를 모욕하였다.
