1. Around July 11, 2013, the Defendant: (a) called the victim C at the Human Place located in the Indonese-si, Asan City, that “I would lend the cargo vehicle to the construction site and pay the cargo vehicle during loaning; (b) borrowed the cargo vehicle under C’s name; (c) while the Defendant was in custody of the said cargo vehicle for the victim, the Defendant was demanded to return the said cargo vehicle from the victim because he did not have contact without paying the installment; (d) the Defendant refused to return the said cargo vehicle by borrowing five million won from the instant cargo vehicle to E, other than the instant case, and without good cause.

Accordingly, the defendant embezzled the victim's property.

2. The Defendant, at around 12:00 on May 22, 2013, at the office of G management located in Nam-gu, Nam-gu, Nam-gu, Seoul Special Metropolitan City on May 22, 2013, lent the Victim H “on the face of lending the check of KRW 50,000,000 (which requires construction cost) to use the check at a discount;

6. Until November 1, 200, it stated that the check at a discount shall be recovered or 50 million won shall be repaid.

However, the Defendant was liable for personal bonds worth approximately KRW 150 million due to the shortage of the construction funds at the time, and the Defendant’s progress had no intent or ability to recover or repay the funds even if he borrowed the above check from the injured party due to the lack of funds to the extent of the date of default on June 2013.

Nevertheless, the Defendant, by deceiving the victim, had the victim acquire approximately KRW 50 million in property benefits by taking away the check from the position of the victim.

3. The Defendant, as described in paragraph 2, laid down a check from H to check up a private document forgery and the use of a certificate of personal seal impression, had the victim I who had previously been engaged in construction work and had the victim I to forge a debt performance certificate using the victim I’s seal and a certificate of personal seal impression.
