1. The Defendants jointly share KRW 181,953,930 with respect to the Plaintiff and KRW 15% per annum from October 23, 2015 to the date of full payment.

Reasons

1. Facts of recognition;

A. The Plaintiff is an organization consisting of representatives from each floor elected by residents, etc. in Gwangjin-gu Seoul Special Metropolitan City Atel (hereinafter “A”), and the Defendants acquired ownership of 1/2 shares of D and E (hereinafter “former owners”)’s 1st floor reinforced concrete building A, 417 square meters, sharing D and E (hereinafter “former owners”) used as public bath facilities on February 23, 2015.

B. The previous owner occupied and used a warehouse of 52.56 square meters, warehouse of 8.25 square meters, warehouse of 49.5 square meters, and warehouse of 29.5 square meters (hereinafter referred to as “instant warehouse”), which is the common area of A, and the Defendants possess and use the said warehouse since the acquisition of the ownership of the instant rain or facility.

(c) The details of the management rules for multi-family housing A related to this case shall be as follows:

Article 1(Purpose) of this Code provides for matters necessary for the management and use of multi-family housing within a complex A, incidental facilities and welfare facilities jointly owned by occupants, and sites and accessories thereof, and (1) In order to achieve the purpose of Article 1, occupants shall have the council of occupants' representatives comprised of representatives by floor and the management body.

(3) The council of occupants' representatives shall be responsible for determining matters stipulated by these rules as a deliberative body and supervising the affairs of the management body, and the management body shall be responsible for managing such matters in accordance with relevant Acts and subordinate statutes, these rules, and matters determined by the council

(2) Representatives shall be elected with the consent of a majority of occupants, etc. of the relevant consent.

Article 16 (Composition of Council of Residents' Representatives) (1) The council of occupants' representatives shall consist of representatives of occupants.

(2) The council of occupants' representatives shall have the following executives:

1. One chairperson, and

2.1 Secretary;

3. One auditor.
