[criminal history] On May 10, 2013, the Defendant was sentenced to a maximum of two years and six months of imprisonment with prison labor for robbery, etc. at Seoul Northern District Court, and on July 13, 2013, the judgment became final and conclusive on September 6, 2015, and completed the execution of the sentence at Kimcheon Prison on September 6, 2015.

[Criminal facts]

1. On December 25, 2016, from around 07:17:38 to around 07:38 of the same day, the Defendant: (a) opened an unlocked main window and discovered a simple safe on the carper in Dobong-gu Seoul Metropolitan Government; (b) brought about a knife a cable connected with a simplified safe by using a knife in the main room; and (c) brought about a safe of KRW 100,000 at the market price owned by the victim, which includes approximately KRW 50,000 in cash.

Accordingly, the defendant invaded another person's structure at night and stolen another's property.

2. An attempted special thief;

A. On March 10, 2017, the Defendant: (a) around 06:37, at the time of “F cafeteria” operated by the victim E, the second floor of the instant D main building; (b) attempted to remove the entrance door so as to open the locking door, so long as the Defendant’s shoulder door door is obstructed; and (c) attempted to remove the entrance by breaking the air conditioning pipe installed front of the entrance, and then open the entrance. However, the Defendant failed to open the entrance.

Accordingly, the Defendant attempted to steals another person's property by destroying part of the door at night and impairing a structure, but attempted to commit it at the wind which does not open the entrance.

B. Accordingly, the Defendant attempted to steals another's property by destroying a part of a structure at night and impairing a structure, but did not commit an attempted crime because there was no stolen object.
