Each public prosecution against the Defendants is dismissed.
1. The Defendants were adjoining one another; Defendant B, around 15:10 on May 3, 2020, cleaned waste in front of the Jung-gu Seoul Metropolitan Government C lending, while cleaning a cigarette butts. The Defendants collected cigarette butts in front of the residence of Defendant A.
The defendant A used the balp bomb of the defendant B, and assaulted him at one time, and the defendant B used the defendant A as his hand against the assault of the defendant A.
2. Determination
(a) Applicable legal provisions: Article 260(1) of the Criminal Act;
(b) Crimes of non-violation of intention (Article 260 (3) of each Criminal Act);
C. Expression of intent that the defendants and victims do not want to punish each other after the indictment of this case
(d) Judgment dismissing public prosecution (Article 327 subparagraph 6 of each Criminal Procedure Act);
